Frequently Asked Questions

Do I need identification for notarization?

Yes. Virginia law requires the notary to verify the identity of each signer. Acceptable identification typically includes a current government-issued photo ID such as a driver’s license, passport, or other official identification. Identification may be expired, but it must not be expired for more than 12 months.

Does the signer need to understand the document being notarized?

Yes. Virginia law requires the signer to appear aware of the document and to sign voluntarily.

Can a Virginia notary notarize a copy of a document?

Virginia notaries generally cannot certify copies of documents themselves. However, a signer may make a copy certification by document custodian, which the notary can notarize.

Can a Virginia Notary explain the contents of a document?

No. A notary public is not permitted to give legal advice or explain the legal effect of a document. If you have questions about a document, you should consult an attorney.

Do witnesses need to be present for notarization?

Some documents require witnesses in addition to notarization. Witness requirements are determined by the document itself or by the organization requesting the document. If witnesses are required, they must be adult and have valid identification. They may not be named in the document or benefit from it.

If witnesses are required and you are unable to provide them, Loudoun Apostille may be able to arrange for witnesses to attend the appointment for an additional fee. Please mention this when scheduling so arrangements can be made in advance.
